SpinX Kentucky Settlement: Social Game Developer Agrees to Pay $285,500

Social casino developer SpinX Games has agreed to pay $285,500 to settle a class action lawsuit in Kentucky. Once the court finalizes the settlement, state residents who wish to claim a portion of the money will have until Feb. 20, 2025, to complete a claim form, which will require proof that they made a purchase in one of SpinX’s products.

The company’s games include Cash Frenzy, Lotsa Slots, and Jackpot World. The plaintiff, Brooke Kingston, alleged that these products violated Kentucky’s gambling laws by selling virtual coins. SpinX has denied any wrongdoing but has agreed to the settlement and to make changes to its games, including adding responsible gaming features and ensuring players can continue to play without waiting an “unreasonable” amount of time to get more free coins. The final approval hearing for the settlement is scheduled for Jan.13, 2025.

Who’s Eligible for the SpinX Settlement?

The SpinX Games settlement applies only to Kentucky residents who have spent at least $5 in a 24-hour period during the applicable period on the following games:

  • Cash Frenzy between Dec. 18, 2018, and Feb. 24, 2021
  • Lotsa Slots between Mar. 27, 2019, and Feb. 4, 2021
  • Jackpot World (previously known as Jackpot Mania) between May 18, 2018, and Mar. 8, 2021
  • Jackpot Crush between Nov. 26, 2019, and Feb. 24, 2021
  • Vegas Friends between Apr. 13, 2019, and Mar. 2, 2021

Under the terms, eligible players will receive an equal share of the Settlement Fund. The amount will vary based on the user’s spending and the number of valid claims.

Eligible Kentucky players must complete the form on the SpinX Games Settlement Site by Feb. 20, 2025. Alternatively, they can call 1-888-825-1288, but electronic filing is recommended. The claim form was not live yet at the time of writing, but it says it will be soon. Those wishing to fill a claim must provide their User ID (if known) as proof of purchase. Note that filing a false claim is an act of perjury and could result in legal consequences.

Those with a claim should expect a payment within 90 days after the final approval of the settlement.

Kentucky’s History With Social Gaming Sites

Social casinos, like the ones developed by SpinX, allow players to play casino-style games like slots for free. They aren’t regulated gambling sites, but some—often called “sweeps casinos“—offer the opportunity to win cash prizes under US sweepstakes laws. They operate under federal law, which makes them level in most US states, even those that haven’t legalized real money online casinos.

Social gaming sites don’t accept cash deposits but sell virtual coins or chips with no redeemable cash value. However, several lawsuits have challenged this logic, arguing that the gameplay itself is a “thing of value.” That logic hinges on the fact that, historically, players could not continue to play once they ran out of chips or would have to wait a long time to get more. Most social gaming companies have since amended their games to allow easier continued free-play options.

Because of its strict laws, Kentucky has produced a disproportionate number of lawsuits relating to social casinos. In the span of two years, three social gaming companies have agreed to class action settlements totalling over $14 million. All companies denied wrongdoing but made changes to their products, similar to those SpinX has agreed to.
